These Terms of Service govern access to and use of the Joma Shop website and services. The website is operated by BERRYCO LLC. By using the website, a user agrees to these terms and the policies incorporated into them. If a user does not agree, the user should not access or use the website.

To the maximum extent permitted by law, neither BERRYCO LLC nor its service providers will be liable for indirect, incidental, special, punitive, or consequential loss arising from website use or a product purchase. Where liability cannot be excluded but may be limited, total liability relating to an order will not exceed the amount paid for the affected product or order. These limitations do not apply to liability that applicable law does not allow us to exclude or limit.

Indemnity

To the extent permitted by law, a user agrees to reimburse BERRYCO LLC for reasonable losses and costs caused by the user's unlawful misuse of the website, fraud, infringement of another person's rights, or material breach of these terms. This clause does not apply to ordinary consumer use or restrict a non-waivable right.

Governing Law and Disputes

These terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. Before filing a claim, the parties should attempt in good faith to resolve the issue through customer support. Subject to any mandatory consumer venue right, courts located in Fort Bend County, Texas, and any federal court with jurisdiction over that area will have jurisdiction. Nothing in this clause prevents a consumer from using a regulator, small-claims process, or other remedy available under mandatory law.

Changes and Severability

We may update these terms by publishing a revised version with a new last-updated date. Changes apply prospectively unless law permits otherwise. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.

These Terms of Sale apply to products purchased from Joma Shop, operated by BERRYCO LLC. They should be read with the Shipping Policy, Return and Refund Policy, Purchase and Order Cancellation Policy, and Terms of Service.

Order and Contract Formation

Submitting an order is an offer to buy the selected products. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we dispatch the product or otherwise expressly confirm acceptance. We may reject, limit, or cancel an order before acceptance for inventory, payment, fraud, pricing, legal, shipping, or resale concerns.

Products

Customers must review the product name, concentration, size, condition, packaging designation, and quantity before checkout. Tester, unboxed, vintage, discontinued, damaged-box, or other special-condition merchandise will be identified where applicable. Manufacturer packaging and formula may change without notice.

Pricing and Payment

Prices are shown in the currency presented at checkout and may change before an order is placed. Applicable tax, shipping, duty, and other disclosed charges are added at checkout where required. The customer authorizes us and our payment providers to charge the selected payment method. If a clear pricing or description error affects an order, we may contact the customer for approval at the corrected price or cancel and refund the affected item.

Availability and Quantity Limits

All orders depend on availability. Inventory records may occasionally be inaccurate. We may limit quantities, reject orders that appear intended for unauthorized resale, or cancel an unavailable item. If we cannot supply an accepted item, we will provide the notice and refund required by law.

Delivery and Risk of Loss

Delivery is governed by the Shipping Policy. Risk of loss passes to the customer when the order is delivered to the address provided, except where applicable law provides otherwise. The customer is responsible for providing a secure and accurate delivery location.

Fragrance Characteristics

Fragrance perception and performance vary with skin chemistry, application, storage, climate, reformulation, and olfactory sensitivity. Notes, season, gender, longevity, sillage, and projection descriptions are subjective guidance and not guaranteed performance specifications.

Product Safety

Follow the manufacturer's labeling and use fragrance only as intended. Many fragrances are flammable; keep them away from heat, sparks, flame, and children. Avoid contact with eyes and discontinue use if irritation occurs. A customer with allergies or sensitivities should review ingredients and seek appropriate professional advice before use. Website content is not medical advice.

Returns Refunds and Cancellations

Returns, refunds, replacements, and cancellations are governed by the separate policies published on the website. Opened, sprayed, or used fragrance normally cannot be returned for preference or change of mind. Sale and final-sale restrictions do not eliminate any remedy that mandatory law requires.

Consumer Rights

These terms do not exclude or limit a right, warranty, remedy, or liability that applicable consumer law does not permit us to exclude or limit. If a policy conflicts with a mandatory legal right, the mandatory legal right controls to the extent of the conflict.
